Exclamation Wrecked!!!

So I am riding home the other day, go to take a left, and my 250r comes right out from underneath me! Thanks to all the apparent snowfall we have here in SC when its 90 out, there had to be almost an inch and a half of sand/gravel in the cutover lane. So i break my left collarbone, get some road rash, and F@#K up my bike. 15 minutes later a guy on a Harley goes down in nearly the SAME SPOT!! So now I am submitting a damages claim form to SCDOT...we'll see if they take responsiblity for not properly maintaining the roads! Anyone ever take this route before?

I fell on my ass back in '88 because some jackoff road commissioner decided gravel was too expensive and put black cinders from the local coke plant on the hot, bubbling tar in the road. It looked just like cold-patch blacktop, but it was like riding on marbles. I doubt you have any legal recourse, but you might be able to raise awaremess and help save the next guy from the morons who are charged with maintaining the roads.

Contact them and the AMA. The AMA may be able to help you out if there is anything you can do. I had a complaint about the Ohio DOT a while back that caused damage to my vehicle (they didn't properly mark and redirect traffic in a construction area and I took a one and a half foot drop from road surface to dirt at 2:30am) and they told me the only way I could get them to do anything about it is if I could PROVE that they screwed up. And since I didn't call and file a report at the time (I didn't notice my rims were bent until the next morning), I couldn't prove it.

However, you have an accident report backed up by at least one police officer...sooo, you may have a shot. Good luck.
